Even experienced contracting personnel may not be aware of the laws and regulations that apply to their work. The Construction and Architect-Engineer Services Credential Credentials Program provides the thorough review — or robust refresher — needed to maintain relevant certifications. It supports the competency standards set by NCMA’s ANSI-accredited, Contract Management StandardTM Publication (CMS), and the corresponding Contract Management Book of Knowledge (CMBOK) standards. Program participants will learn: 

  • The unique guidelines, nuances, and approaches needed to successfully obtain goods and services for phases of construction acquisition and contracting 
  • An awareness of and ability to apply the specifics of architecture and engineering services contracting, including relevant laws and regulations
  • The knowledge and skills needed to apply the unique aspects of contracting for architecture and engineer services pursuant to Public Law 92-582, the Selection of Architects and Engineers statute
  • A comprehensive understanding of recognizing a potential construction contract claim, pricing considerations, terminations, and the role of the Civilian Board of Contract Appeals and the courts

After the successful completion of each individual course, you will be sent an electronic Training Certificate. Upon completion of all program requirements, you will receive a specialized digital badge identifying the Construction and Architect-Engineer Services Credentials (Basic)  Program and the associated competencies attained.

CON 244: Construction Contracting

Learning Objectives:

  • Given a construction requirement to build a new facility, renovate an existing one, or maintain existing facilities, apply the required knowledge of laws, regulations, and procedures to the act of properly issuing and administering a construction contract in accordance with federal acquisition laws, regulations, and best business practices.
  • Given a construction contract requirement, devise a construction acquisition plan in accordance with FAR part 7, DFARS 207 (if DoD), and agency policies and procedures.
  • After receipt of a construction contracting request, describe how to develop a construction solicitation package in accordance with FAR, DFARS (if DoD), and agency policy/procedures.
  • After receiving bids or proposals in response to a construction solicitation, evaluate the appropriate construction contract awardee.
  • Given a construction contract, diagnose and determine the applicable construction contract administration (compliance) approach, using FAR, DFARS (if DoD), regulation/guidelines, and best practices.
  • Given a changed condition on a construction contract, select the appropriate clause and describe the remedy for the situation in accordance with federal and DoD acquisition laws, regulations, and best business practices.
  • Given a construction contractor’s invoice, verify for construction progress payments and, at contract conclusion, describe appropriate actions necessary to contract closeout.
